The owner of a sprawling former Johnson & Johnson campus in Somerset County is suing a local town over a new ordinance that could block it from building an artificial intelligence data center at the site.

E. Kahn Development, known as EKD, filed the lawsuit July 31 in Superior Court against Montgomery Township. The developer claims local officials passed a data center ban without a valid land-use reason amid ongoing disputes over the future of the 257-acre property.

The developer is asking a judge to overturn the data center ban and prevent the township from enforcing it. Montgomery is one of several New Jersey communities facing lawsuits over similar bans as fights over AI data centers spread across the state.

The developer is seeking more than $300 million in damages from the township.

EKD says the data center ban has diminished the property’s value and limited its ability to market the campus for what it considers the site’s most valuable potential use.
